Terms of Use

The rules that apply when you use GoBro to publish, book, pay or provide a service in Australia.

1. About these Terms

These Terms of Use govern your access to and use of the GoBro platform, operated by Curtis De Seixas, sole trader, ABN 30 291 712 177, Perth, Western Australia.

2. Acceptance

By creating an account, publishing a listing or making a booking, you accept these Terms, our Privacy Policy and the other policies linked from them.

3. Eligibility

You must be at least 18 years old to use GoBro.

4. Accounts

You choose one username when you sign up. It is unique, 3 to 20 characters, and is the name shown to other members and used to sign contracts.

You can change it later in Profile. Contracts already signed keep the username used at the time.

5. Account security

Keep your password private and do not share your account. Tell us straight away at hello@gobro.com.au if you think someone else has access.

6. Accuracy

Information you give us — profile, listings, prices, availability, documents — must be accurate and kept up to date.

7. Role of GoBro as a platform

GoBro is a marketplace that introduces members to each other. The agreement for a stay, a car hire, a ride or a job is between the members themselves.

GoBro is not a party to that agreement, and is not an insurer, a bank, an agent, a transport operator or an employer.

8. Role of providers

If you offer something on GoBro, you are responsible for holding any licence, registration, roadworthiness certificate, insurance and tax registration your activity requires, and for complying with the law.

9. Role of users

If you book, you are responsible for reading the listing and the contract, turning up on time, treating the property, vehicle or workplace with care, and reporting problems promptly.

10. Listings

Listings are manually reviewed before publication. We can decline or remove a listing that is inaccurate, unlawful, unsafe or contrary to these Terms, and we will tell you why.

11. Bookings

A booking is confirmed once the payment is validated and both parties have signed the contract. You cannot book your own listing.

Minimum rental duration: stays and cars are rented by the week, with a minimum of 7 nights. Rides and jobs are not affected.

12. Contract between users and providers

GoBro generates a written contract for each booking, based on the listing and the details agreed. Both parties sign it electronically with their username.

The signed PDF is stored in your account and can be downloaded at any time.

13. Fees and commissions

GoBro charges a service fee of 15% of the booking amount, with a minimum of AUD 10. The fee is added to the amount paid by the person booking, and the card processing cost is included in that single line — there is no separate surcharge.

Providers pay no per-booking fee: they receive the price shown on their listing.

14. Taxes

GST of 10% applies to the GoBro service fee only where GoBro is registered for GST; when that is the case it is shown on the payment page and on the tax invoice.

You are responsible for your own tax obligations on the income you earn through the platform.

15. Payments

Secure card payment (Stripe) is the recommended method and is treated as the standard way to pay on GoBro: the service amount and the service fee are paid by card and confirmed immediately. There is no card surcharge — the card processing cost is included in the GoBro service fee. GoBro never stores your card details.

Bank transfer (alternative) remains available: transfer the total to the GoBro account using the reference provided; receipts are checked manually within 24 business hours.

GoBro holds the amount and pays the provider within 48 hours after our team validates both completion photos, by Stripe Connect or bank transfer.

16. Cancellations

Cancellation by the person booking: more than 7 days before the start, the booking amount and the deposit are refunded and the service fee is kept; between 7 days and 48 hours, 50% of the booking amount is refunded (the cut-off is 24 hours for rides and for jobs shorter than one day); less than 48 hours before, the booking amount is not refunded and the deposit is returned.

If the provider cancels, the service is not provided, or an event beyond either party's control prevents it, you receive a full refund including the service fee. If you do not turn up, no refund is due.

17. Refunds

Refunds are made by the original payment method within 10 business days of the decision. Your rights under the Australian Consumer Law are not affected.

18. Security deposits

Where a listing requires a security deposit and the booking is paid by card, the deposit is taken as a card hold: GoBro requests an authorisation from your card issuer for the deposit amount and no money is debited. The authorisation stays in place for the duration of the booking and is released automatically once the release period set by GoBro has passed with no dispute open (7 days by default). GoBro may capture part or all of the held amount, never more than the deposit, only where the GoBro team decides so after a dispute or after damage is evidenced by the before and after photos; the reason is given to both members and the decision is logged.

Bank transfer (alternative) remains available. The person booking transfers the total, including any deposit, to the GoBro account using the unique reference shown on the booking. Transfers in Australia usually arrive immediately; GoBro checks the receipt manually within 24 business hours. The deposit paid this way is held separately and returned after the service if no dispute is opened.

Where a listing requires a deposit paid by transfer, it is paid with the booking, held separately from the booking amount and returned after the service if no dispute is opened.

19. Verification

We may ask you to verify your identity before booking or publishing. Document images are deleted within 30 days after verification; only the result is kept.

20. Reviews and ratings

Reviews can only be left after a completed booking. Reviews that are false, abusive, discriminatory or off-topic can be removed.

21. Communications

On-platform messaging opens once the payment is validated and both parties have signed the contract. Keep your conversation on the platform so that a record exists if there is a problem.

The GoBro team can access the messages and documents attached to a booking (contract, payment evidence, handover photos) for safety, support and dispute resolution, and may reply in the conversation as the GoBro team. An account may also be banned permanently for fraud, repeated duplicate listings or conduct that puts members at risk; the associated email address is then blocked from signing up again.

22. Prohibited conduct

  • Taking the transaction off the platform to avoid fees.
  • False identities, false listings or misleading photos.
  • Harassment, threats, discrimination or abusive language.
  • Unlawful, dangerous or unlicensed activities.
  • Interfering with the security or operation of the platform.

23. Fraud

Suspected fraud leads to the payment being held, the account being suspended and, where appropriate, a report to the authorities. You can report scams to Scamwatch.

24. Safety obligations

Follow the safety rules that apply to your activity — roadworthy and insured vehicles, safe accommodation, safe working conditions. In an emergency call 000 first, then tell us.

25. Damage, loss or incidents

Report damage, loss or an incident as soon as you can, with photos and a description. The completion photos taken before and after the service are the main evidence used.

We recommend opening a dispute within 48 hours; this is a recommendation, not a bar to raising it later.

26. Complaints and disputes

Complaints are acknowledged within 2 business days and answered within 10 business days. While a dispute is open, the amount held is not released.

The GoBro team decides how the held amount is released, based on the contract, the photos and the evidence provided. You can ask for an internal review within 14 days.

27. Suspension

We can suspend an account or a listing where there is fraud, a safety risk, a serious breach of these Terms or a legal requirement. We tell you the reason and how to respond.

28. Termination

You can close your account at any time. Bookings already confirmed, payments due and record-keeping obligations survive closure.

29. Intellectual property

The GoBro name, logo, site design and software belong to GoBro. You may not copy or reuse them without our written permission.

30. User content licence

You keep ownership of the photos and text you upload. You give GoBro a non-exclusive licence to host, display and reproduce that content for the purpose of operating and promoting the platform.

31. Privacy

Personal information is handled as described in our Privacy Policy, which forms part of these Terms.

32. AI and automated tools

Our assistant, BROZA, gives general information only. It never makes final decisions about your account, your money or a dispute.

You can ask to speak with a member of the GoBro team at any time.

33. Third-party services

The platform relies on third-party services such as Stripe, Google and our hosting provider. Their own terms apply to the services they provide to you.

34. Availability

We aim to keep GoBro available at all times, but we may need to interrupt the service for maintenance, security or reasons beyond our control.

35. Limitation of liability

To the extent permitted by law, and subject to the section below, GoBro's total liability to you for any claim connected with the platform is limited to the fees you paid to GoBro in the 12 months before the claim.

We are not responsible for the acts or omissions of members, but we are responsible for our own services and for meeting our obligations to you.

36. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies those guarantees or any other right you have that cannot be excluded by law.

Where we are permitted to limit our liability for a service, we may do so by resupplying the service or paying the cost of having it resupplied.

37. Indemnities

You are responsible for loss we suffer because you broke these Terms, acted unlawfully or gave false information. This does not apply to loss caused by our own fault or to anything you cannot be made responsible for by law.

38. Governing law

These Terms are governed by the laws of Western Australia, and the courts of Western Australia have jurisdiction.

39. Changes

We may update these Terms. The current version is published here with its date, and we will tell you about significant changes.

40. Severability

If part of these Terms is found to be unenforceable, the rest continues to apply.
